Happy Bowz is a gift marketplace where you can sell unique and personalized products to buyers nationwide. To ensure the best experience for our sellers and buyers, we kindly request that you, as our valued partner, adhere to our seller policy.

Please note: This policy is an integral part of our Terms of Use. By registering as a seller/vendor on our platform, you acknowledge your agreement to this policy and our Terms of Use. It is important to understand that Happy Bowz reserves the right to suspend or terminate any account found in violation of our policies.

1. Understanding Happy Bowz's Limitations as a Marketplace

Happy Bowz serves as a platform for buyers and sellers to engage in transactions. However, it is essential to acknowledge that Happy Bowz is not directly involved in the actual transaction process. As a seller on Happy Bowz, you understand and agree that:

You are responsible for ensuring the legality of your sales, accurately describing your products, packaging, shipping, insuring, and providing warranty and after-sales service to the buyers. Happy Bowz does not guarantee or endorse any items sold on the platform or the content posted by sellers. Sellers utilize Happy Bowz's website, mobile applications, and services at their own risk.

2. What Can Be Sold on Happy Bowz

At Happy Bowz, we especially encourage the sale of innovative, high-quality gift products, with a focus on Malaysia brands. We value products that are personal, meaningful, and have the ability to be personalized or customized according to the needs of our buyers. We are constantly seeking new product ideas to diversify our portfolio and create a unique shopping experience.

3. What Cannot Be Sold on Happy Bowz

We have certain restrictions on the items and services that can be sold on our platform. We do not allow the sale of items that are prohibited, obscene, offensive, or infringing on the rights of others. We reserve the right to remove any listings that violate our policies, and we may also suspend or terminate your account for serious violations. Please ensure that you review and comply with our guidelines to maintain a positive and trusted marketplace.

Prohibited Items:

a. Illegal or Prohibited Goods: The sale of any items that are illegal to sell or possess, including drugs, firearms, counterfeit goods, or stolen items, is strictly prohibited.
b. Hazardous or Dangerous Materials: Items that pose a safety risk or are considered hazardous, such as explosives, flammable substances, or toxic materials, are not allowed to be sold on the platform.
c. Adult or Explicit Content: The sale of items that contain explicit or adult content, including pornography or sexually explicit materials, is strictly prohibited.
d. Offensive or Discriminatory Items: Items that promote hate speech, discrimination, or offensive content based on race, religion, gender, or other protected characteristics are not permitted for sale.
e. Unauthorized Copyrighted or Trademarked Goods: Selling items that infringe on the intellectual property rights of others, such as counterfeit goods or unauthorized reproductions, is strictly prohibited.
f. Fake Brand of Products: Selling counterfeit or fake branded products is not allowed on the platform.

Please note that this list is not exhaustive, and we reserve the right to remove any listings that violate these policies. It is the responsibility of sellers to ensure compliance with these guidelines to maintain a safe and reputable marketplace for all users.

4. Purchase and Sale of Alcohol

The purchase and sale of alcoholic products, referred to as 'Alcohol', on the Happy Bowz platform are subject to specific terms and conditions. As an Alcohol Seller on the Happy Bowz platform, it is your responsibility to ensure that the buyer and recipient of alcohol meet certain requirements. Specifically, you must ensure that:

4.1 The buyer and recipient are aged 21 or above
4.2 The buyer and recipient are not Muslim or otherwise prohibited from buying alcohol under any law, regulation, or religion
4.3 The buyer and recipient understand the following statement: “MEMINUM ARAK BOLEH MEMBAHAYAKAN KESIHATAN” (Drinking alcohol can be detrimental to health)
4.4 In case Happy Bowz requests it, as an Alcohol Seller, you may be asked to provide photo identification for age verification purposes. This is to ensure that buyers and recipients of alcohol meet the legal age requirement of 21 years or above. Your cooperation in providing the necessary identification helps maintain a responsible and compliant environment for the sale of alcoholic products on the platform.

Additionally, as an Alcohol Seller, you represent and warrant that:

4.5 You are not Muslim or otherwise prohibited from selling alcohol under any law, regulation, or religion
4.6 You hold all necessary licenses and/or permits to sell alcohol through the platform. If requested, you must provide a copy of such licenses and/or permits and supporting documents to Happy Bowz immediately for verification purposes.
4.7 All information and documents provided to Happy Bowz are true and accurate.

Both the Alcohol Buyer and Alcohol Seller agree to protect and hold harmless Happy Bowz, its affiliates, and employees (collectively referred to as the 'Indemnified Parties') from any claims, liabilities, damages, or expenses incurred by the Indemnified Parties due to:

a. Any inaccurate or breached representations made
b. Any violation of laws or rights of a third party.

By accepting these terms and conditions, all parties contribute to maintaining a safe and responsible environment for buying and selling alcoholic products on the Happy Bowz platform.

5. Representation of Your Shop and Its Products

Sellers are expected to uphold a high degree of honesty and transparency in their dealings with customers. By selling on our platform, you agree to the following:

5.1 Provide Honest and Accurate Information: Provide honest and accurate information on your shop's profile page, including details about your business, products, and policies.
5.2 Accurate Product Representation: Accurately represent your products and disclose all necessary information, such as product descriptions, features, specifications, and any relevant disclaimers. Users have the right to flag listings for misrepresentation or fraud.
5.3 Honor Shop Policies and Promises: Honor your shop policies, including delivery timeframes, return policies, and any promises made to customers regarding product availability, quality, or special offers.
5.4 Respect Intellectual Property: Respect the intellectual property rights of others. Do not sell counterfeit, unauthorized, or infringing products.
5.5 Avoid Creating Duplicate Shops: Do not create multiple shops for the same business or purpose. Maintain a single shop and manage your listings accordingly.
5.6 Avoid Fee Avoidance: Do not engage in fee avoidance practices that aim to evade or circumvent the platform's fees or policies. Familiarize yourself with our fee policies and ensure compliance.
5.7 Responsible Content Upload: Do not upload content that is abusive, threatening, defamatory, harassing, obscene, vulgar, false, deceptive, misleading, or in violation of someone else's privacy or intellectual property rights.

It is important to note that any violation of these guidelines may result in the removal of your listings, suspension, or termination of your account. We encourage sellers to maintain a professional and ethical approach to ensure a positive experience for both sellers and buyers on our platform.

6. Customer Service Standard

We place great importance on providing a high standard of customer service to ensure a positive experience for buyers on our platform. As a seller on Happy Bowz, you agree to adhere to the following customer service standards:

6.1 Honoring Processing and Delivery Time: Honor the processing and delivery time that you specified on your product page. It is essential to deliver buyers' orders promptly, unless exceptional circumstances arise or alternative arrangements are specified. Timely delivery is crucial, as nobody likes receiving a birthday gift a week late!
6.2 Honoring Commitments: Honor any other commitments you make in your store or product policies or descriptions. It is important to provide accurate information and ensure that buyers receive exactly what they purchased. Misrepresentation or deviation from the stated commitments can lead to customer dissatisfaction.
6.3 Timely Communication: Respond to customer inquiries and messages in a timely fashion. Prompt and courteous communication helps build trust and ensures a positive customer experience. Aim to address customer queries and concerns promptly to maintain good communication.
6.4 Order Fulfillment: Fulfill customer orders according to reasonable requirements to the best of your ability. Make every effort to ensure that the products are prepared, packaged, and shipped in a timely manner, meeting the specified quality standards. In the event that you are unable to complete an order, promptly notify the buyer via your vendor dashboard and cancel the transaction as necessary.
6.5 Professional Dispute Resolution: Handle any disputes or issues with buyers in a professional and respectful manner. Make an effort to resolve conflicts by engaging in open and constructive communication with the buyer. If a resolution cannot be reached, please contact the Happy Bowz support team for further assistance.

Adhering to these customer service standards is essential for maintaining a positive reputation as a seller on our platform. Providing excellent customer service contributes to customer satisfaction, repeat business, and a thriving marketplace.

7. Communication Rules & Regulations

To maintain a respectful and professional environment on our platform, sellers are required to adhere to the following communication rules and regulations:

7.1 Prohibition of Unsolicited Materials: Communication should not involve sending spam, advertisements, promotions, or any other unsolicited materials to buyers. Respect the privacy and preferences of other users by refraining from engaging in such activities.
7.2 No Harassment or Abuse: It is strictly prohibited to harass or abuse other sellers on the platform. Treat fellow sellers with respect and professionalism in all your interactions.
7.3 No Disturbance to Other Sellers' Business: Avoid causing disturbance or disruption to the business of other sellers. For example, refrain from purchasing from a seller solely to leave a negative review or discrediting another seller when communicating with another Happy Bowz user.
7.4 Compliance with Personal Data Protection Act 2010 (PDPA): Adhere to the regulations set forth by the Personal Data Protection Act 2010 (PDPA) enacted by the Malaysian government. Ensure that your communication on the Happy Bowz platform is in compliance with the PDPA guidelines to protect the personal data of individuals involved in commercial transactions.
7.5 Responsible Use of Buyer Information: As a seller, you may have access to buyer's information due to the transaction. This information should only be used for Happy Bowz-related communication or Happy Bowz-facilitated transactions. It is strictly prohibited to use this information for unsolicited commercial messages or unauthorized transactions. Sellers are not allowed to add any Happy Bowz user to their email or physical mailing list without explicit consent, nor store or misuse any sensitive information without the buyer's consent.

By adhering to these communication rules and regulations, sellers contribute to a safe and respectful marketplace environment where trust and professionalism are maintained.

8. Using Our Review System

Our review system is designed to provide valuable feedback and insights to both buyers and sellers. Here are some guidelines for using the review system effectively:

a. Timeframe for Reviews: Buyers have a 30-day window from the expected delivery date of their item to leave a review. We encourage buyers to share their feedback within this timeframe to ensure it is timely and relevant.

b. Content Restrictions for Reviews: Reviews and seller's responses to reviews should adhere to the following guidelines:

  • No use of obscene, vulgar, racist, or offensive language
  • Avoid including private or confidential information in your reviews
  • Refrain from adding any form of advertising or spam in your reviews
  • Do not engage in any activities that manipulate reviews, such as shilling or extortion. Attempts to influence reviews through threats, intimidation, bribery, or offering additional goods, services, or compensation in exchange for positive reviews will be strictly dealt with
  • Reviews should not undermine the integrity of Happy Bowz's review system

c. Honest and Unbiased Opinions: Reviews should reflect the genuine opinions and experiences of buyers. We encourage buyers to provide honest and unbiased feedback about their purchase, taking into consideration factors such as product quality, shipping experience, and customer service.

By following these guidelines, buyers contribute to maintaining the integrity and reliability of our review system, helping other users make informed decisions and fostering a transparent and trustworthy marketplace environment.
